Resolving NYC Building Violations: From Corrective Work to Closure
A building violation can involve several separate tasks: understanding the notice, correcting the condition, handling a hearing or penalty, and confirming that the issuing agency accepts the resolution. Keeping those steps visible helps owners and managers avoid a case that looks finished internally but remains open in city records.
Start with the actual notice
Record the issuing agency, violation or summons number, address, cited condition, hearing date, and any correction deadline. Keep the original notice and check the current agency record. Different agencies and violation types follow different procedures.
Build a corrective-work plan
Assign responsibility for reviewing the condition, determining the necessary work, and arranging access. Identify whether licensed professionals or permits are required. Keep photographs, invoices, permits, inspection results, and other supporting records together as the work progresses.
Separate penalties from correction
For DOB-issued OATH summonses, paying an OATH penalty alone does not resolve the DOB violation record. Unless a summons is dismissed, DOB generally requires correction of the cited conditions and an acceptable Certificate of Correction. A hearing outcome and the correction status therefore need separate tracking.
Submit the appropriate correction filing
DOB’s current Certificate of Correction process uses DOB NOW: Safety. Review the required supporting documents and attestations before submission, then monitor the filing status and any request for additional information. DOB civil penalties must be paid or waived before a Certificate of Correction can be approved.
Confirm closure and retain the case file
Set a follow-up date after submission. Compare the agency’s decision with the case record and retain the confirmation. If a filing is rejected or another requirement remains outstanding, assign the next action and deadline rather than marking the entire case complete.
